The WorkSafe Group (WorkSafe) of the Department of Local Government, Industry Regulation and Safety is inviting public submissions on the statutory review (the Review) of the Work Health and Safety Act 2020 (WHS Act) Discussion Paper.
Section 277 of the WHS Act requires the Minister (Minister for Industrial Relations) to undertake a five-yearly review on the operation and effectiveness of the WHS Act and prepare a report for Parliament based on the Review.
To assist the Minister for Industrial Relations with the WHS Act Statutory Review, WorkSafe has prepared a number of topics and questions throughout the Discussion Paper for your feedback.
Important note
The scope of the Review does not formally include a review of the Work Health and Safety (General) Regulations 2022, Work Health and Safety (Mines) Regulations 2022, Work Health and Safety (Petroleum and Geothermal Energy Operations) Regulations 2022 or Codes of Practice (codes) under the WHS Act. Any future changes to the abovementioned regulations or codes will be a decision for Government. The Review is concerned with the operation and effectiveness of the WHS Act. If you would like to provide general feedback on the operation and effectiveness of the WHS Act, unrelated to the specific questions, that feedback will also be considered.
How to make a submission
When providing your feedback, please consider the questions posed throughout the Discussion Paper and use the submission template provided to send comments to WHS_Act_Statutory_Review@lgirs.wa.gov.au.
Your feedback will help to inform the Minister’s review report recommendations to Parliament in late 2026.
Submissions will close on 28 November at 5pm (Australian Western Standard Time).
